ALL CLAIMS MUST BE BROUGHT SOLELY IN A PARTY’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, CONSOLIDATED ACTION, REPRESENTATIVE ACTION OR PROCEEDING.

Dispute Resolution

If a dispute should arise between you and MPA, we want to provide you with a resolution that is efficient and cost effective by using our customer service team. Almost all customer service disputes can be resolved to the customer’s satisfaction by using our customer service, reachable by calling 800-924-9521 or emailing customerservice@motrocarparts.com. If you have a technical issue with one of our parts, you can receive assistance by calling technical support at 800-228-9672 or emailing technicalsupport@motorcarparts.com.
If your dispute cannot be resolved using our customer service team, you agree to submit any disputes arising from these Terms or your use of the website, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying California law.
TO THE EXTENT PERMITTED BY APPLICABLE LAWS, YOU AND MPA AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SITES AND THE COMMUNITY MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED. The preceding sentence does not apply to New Jersey residents.

Applicable Law

All matters relating to these Terms and the website, including the validity, performance and construction of these terms, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of California and the United States of America without giving effect to any choice or conflict of law provision or rule. You further expressly consent and agree to submit to the exclusive jurisdiction and venue of a court of competent jurisdiction located in Los Angeles County, California.

Right to Amend Terms

Although the website is accessible worldwide, not all products or services discussed on the website may be available in all geographic locations. MPA reserves the right to restrict the provision of any product or service to any person, company, geographic location it desires, in compliance with applicable law.

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and MPA’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
